Rezumat

Commercialization and technology transfer is an important pillar of the effective IP management. Taking into account that in the past the focus of IP management was on protection the IP rights, today increased emphasis is being placed on the economic utilization of IP assets. This is why most IP strategies consider commercialization and technology transfer as key to the promotion of intellectual property and identified the following reasons for that: · The level of commercialization is minimal. · Many developing countries and less developed countries are dependent on imported technologies (it is a reality for both Moldova and for the neighbouring countries), and do not have in place technology transfer policies that would facilitate the development of their technological capabilities over time. Such countries remain dependent on imported technologies for a long time. · Most universities do not have the commercializations upport structures that are required in order to promote the commercialization of IP rights, for instance, commercializations upport structures such as technology transfer offices, university companies, technology incubators, prototype development facilities, or science and industrial parks. · Most financial institutions do not accept IP as collateral for accessing investment finances. · The practice of providing a recognized system for the valuation of IP, which is important for the commercialization of IP assets, is still not commonplace. As such, the use of IP in financial reporting mergers and joint ventures, and in the privatisation of public companies, remains negligible. · Access to finance through monetisation or securitisation is not yet commonplace. · The use of IP technologies in the public domain is minimal; some companies seek the licensing of technologies which they could otherwise obtain free of charge. · There are insufficient numbers of IP commercializationprofessionals available to carry out IP valuations as well as provide licensing, and negotiations and technology management. The problems enumerated above should be the starting point of policies and strategies for intellectual property and technology transfer of any organization.
