Access to justice is also the fundamental right of the person and the positive obligation of the state, which allows the person to be "heard" and to take all measures to repair the guaranteed right. From the content of the conventional provisions, recent jurisprudential developments, it follows that access to justice is an obligation of purpose and means. Women, as a vulnerable category of the population of states, victims of multiple forms of discrimination, will particularly benefit from free access to justice. |
