The Competition Council decides on the existence or absence of an infringement, by approaching the legal and economic issues and by evaluating the circumstances in which the deeds occurred. Any investigation of a case implies the existence of a set of probation rules, which, when respected, allow the accumulation of the evidences that are going to substantiate the final verdict. Unlike the court of law, which has a guiding role in the organization and execution of the civil proceedings, the Competition Council has an active position in the investigation of the cases. The probation is the activity of the competition authority and of the parties, carried out by the process means set out by the law, aiming at identifying the objective truth about the existence or absence of certain circumstances, necessary for settling the dispute between the parties. The evidences can be considered those facts (information) acquired legally, which serve to determine the existence or absence of an infringement, as well as of other relevant circumstances linked to the case, such as the relevant market, the subjects, the cause-effect connection etc. |
