GENERALITIES ON THE CONSTITUENT ELEMENTS OF A CARTEL The author analyses in this article the constituent elements of a cartel from the perspective of the legislation of the Republic of Moldova, the European Union, bringing practical examples from the European Commission and the European Court of Justice’ jurisprudence and concludes that an in-depth understanding of the subtleties of every element, contributes to a better implementation of competition law by national competition authorities and courts.

GENERALITĂŢI CU PRIVIRE LA ELEMENTELE CONSTITUTIVE ALE UNUI CARTEL Autorul analizează în acest articol elementele constitutive ale unei înţelegeri de tip cartel din punctul de vedere al legislaţiei Republicii Moldova, Uniunii Europene, aducând exemple practice din jurisprudenţa Comisiei Europene şi a Curţii Europene de Justiţie, concluzionând că o înţelegere aprofundată a subtilităţilor fiecărui element, contribuie la o mai bună implementare a legislaţiei în domeniul concurenţei de către autorităţile naţionale de concurenţă şi instanţele de judecată.

ОБЩИЕ ПОЛОЖЕНИЯ О СОСТАВНЫХ ЭЛЕМЕНТАХ КАРТЕЛЯ Автор анализирует составные элементы картеля с точки зрения законодательства Республики Молдова и Европейского союза, приводя практические примеры из практики Европейской комиссии и Европейского суда, и приходит к выводу о том, что полное понимание тонкостей каждого элемента способствует лучшему применению законодательства в области конкуренции национальными конкурентными ведомствами и судами.
