Появление сети Интернет оказалось революционным событием для мирового информационного и культурного обмена. Особенность сети Интернет – отсутствие в ней какого-либо подобия государственных границ, стал возможен свободный обмен информацией между гражданами разных стран, размещение произведений науки, литературы и искусства, с которыми потенциально может ознакомиться самая широкая аудитория. Большая часть информации, размещаемой в сети Интернет, охраняется авторским правом и смежными правами. В этих условиях, существует целый ряд проблем при охране прав авторов, исполнителей, производителей фонограмм и вещательных организаций. Возникающие проблемы носят принципиально новый характер, поэтому отсутствуют отработанные способы их решения.

Apariţia Internetului a constituit un eveniment crucial care a revoluţionat schimburile culturale şi de informaţii la nivel mondial. Specificul reţelei Internet constă în lipsa oricăror aparene de frontiere de stat, astfel devenind posibil schimbul liber de informaţii între cetăţenii din diferite ţări, plasarea operelor ştiinţifice, literare şi artistice, care ar putea  fi potenţial disponibile publicului larg. Cea mai mare parte a informaţiilor publicate pe Internet este protejată prin drept de autor şi drepturi conexe. În aceste condiţii, există o serie de probleme aferente protecţiei drepturilor autorilor, interpreţilor, producătorilor de fonograme şi organizaţiilor de difuziune. Problemele care apar poartă un caracter fundamental nou, astfel încât nu există un algoritm bine definit de rezolvare a acestora.

The advent of the Internet network proved a revolutionary event for the worldwide information and cultural exchange. The feature of the Internet network - lack therein of any semblance of state borders, has been made possible the free exchange of information between citizens of different countries, placement of the works of science, literature and art, with which can potentially familiarize the widest audience. Most of the information posted on the Internet is protected by copyright and related rights. Under these conditions, there are a number of problems in the protection of the rights of authors, performers, producers of phonograms and broadcasting organizations. Emerging problems have fundamentally new character, so there are no well-tested methods for their solution.
