According to the Constitution of the Republic of Moldova, the universally recognized principles and norms of international law and international treaties of Moldova are an integral part of its legal system. This fully applies to the labor law and social relations closely related to it. This means that the relationship between the employer and employee, established on the territory of the Republic of Moldova, is governed both by national and international legal frameworks. The rules of international labor law can be defined as regulation of labor relations, according to the settlements of international organizations and treaties that Moldova had ratified. The most important act among these is he Universal Declaration of Human Rights adopted by the United Nations General Assembly in 1948. Alongside with other rights, the Declaration establishes the right to work, the free choice of employment, the right to just and favorable conditions of work, the right to protection against unemployment, the right to equal pay for equal work and other. The legal acts of International Labor Organization (ILO) have an increased popularity. These acts are adopted in form of Conventions and Recommendations, and lately no ratification of them is needed, besides a law adoption by the country. The relevance of the topic consists is explained by the existing gaps in the legislation of Moldova that establishes the social protection and security, as well as by the law level of social security and non-ratification of most conventions governing social protection and social security.

Conform Constituţiei RM, principiile generale ale normelor dreptului internaţional şi tratatele internaţionale la care Moldova este parte sunt parte integră a sistemului legislative al ţării. Aceasta se răsfrânge în totalitate şi asupra reglementărilor rapoartelor juridice de muncă şi rapoartelor sociale ce reies dintre acestea. Cu alte cuvinte, rapoartele de muncă care se stabilesc între angajatori şi angajat, care se află pe teritoriul ţării, sunt reglementate atât de cadrul legislativ naţional cât şi cel internaţional. Reglementarea internaţională a muncii poate fi definită ca reglementarea rapoartelor de muncă în baza normelor naţionale, cât şi în baza ratificării normelor organizaţiilor şi tratatelor internaţionale.Printre actele normative internaţionale, în primul rând se numără Declaraţia Universală a Drepturilor Omului, adoptată de către Adunarea Generală ONU în 1949. Alături de alte drepturi, Declaraţia asigură dreptul la muncă, dreptul la libera alegere a muncii, dreptul la condiţii echitabile şi satisfăcătoare de muncă, precum şi la ocrotirea împotriva şomajului, dreptul la salariu egal pentru muncă egală, şi altele. Sunt bine cunoscute şi actele Organizaţiei Internaţionale a Muncii (OIM), care este o agenţie specializată a ONU. Aceste acte se adoptă în forma unor Convenţii şi Recomandări, care în ultimul timp nu mai necesită a fi ratificate, odată fiind adoptată legea ţării în cauză. Actualitatea temei date reiese din legislaţia imperfectă a Republicii Moldova, care reglementează protecţia şi securitatea socială, nivelul jos de securitate socială, neratificarea majorităţii convenţiilor care reglementează protecţia socială şi securitatea socială.
