În acest articol este examinat raportul dintre obligaţia de livrare a bunurilor conforme cu contractul şi regula res perit domino după implementarea Directivei 1999/44/CE în legislaţia italiană. Prin analiza funcţionării în practică a noilor norme legislative sunt evidenţiate lacunele existente şi soluţiile posibile pentru a asigura o protecţie efectivă a consumatorului, inclusiv prin prisma prevederilor din legislaţiile altor state membre ale UE.

This article examines the relationship between the obligation to deliver goods in conformity with the contract and the rule res perit domino after the implementation of the Directive 1999/44/CE into Italian law. Taking into account the practical issues arising from the application of the new legal provisions, point out the law gap and the possible solutions in order to give a higher consumer protection, including the examinations of the provisions of other member states of EU.
