Despite the development of international legal thought one of the most difficult areas of research of modern science is international law's theory. Theoretical issues are rarely raised by recognized classics, but young researchers don't hasten to participate in their decision. The theme of this article is the subject of author’s dissertational thesis; all issues related to international energy law and its place in the system of modern international law, of course, is impossible to describe in a few pages. Nevertheless, it is necessary to pay attention on the main points.
The article is dedicated to the analysis of international energy law as a branch of contemporary international law, determination of its place in the system of international law. Also the peculiarities of contemporary international law, criteria for determination of branch of international law, interrelations between international energy law and international economic law are being analyzed. The determination of international energy law as a branch of international law is a national interest of States-importers of energy resources as this will secure transparency of relations and will increase the role of State in regulation of international relations in energy sphere. Today, international energy law can be defined as a set of principles and norms of international law that govern relations between states concerning extraction, use, trade, transit and supply of energy resources. It is a part of public international law. |
