Rezumat

The study deals with a number of factors which would be responsible for the increased fragmentation of public international law, such as: the proliferation, regionalization and sectorization or specialization of international law, as well as self-contained regimes. All such factors would threaten the unity of the international legal system. The fragmentation has a dual effects, both the negative one and the positive too. The negative effects would constitute a threat to the reliability and credibility as well as effectivity of the system of international law. On the other hand, the positive effects are able to accommodates various needs and concerns of different states and that means a better compliance with international law, even increased harmonious regulations and the stability of international relations. At the same time, the proliferation and fragmentation might reveal the healthy and reflective power of the maturity of international law.

Исследование рассматривает ряд факторов, которые могут нести ответственность за увеличение степени фрагментарности в международном публичном праве, среди них: пролиферация, разветвление, векторизация или специализация международного права, а также отдельно взятые режимы. Все эти факторы могут угрожать единству международной правовой системы. Фрагментарность может оказывать двойное значение, как отрицательное, так и положительное. Отрицательное значение может представлять угрозу надежности и доверию, а также эффективности системы международного права. С другой стороны, положительное значение в силах адаптировать различные потребности и волнения разных государств, что означает высокую степень соответствия международному праву, даже высокую гармонизацию управления и стабильность международных отношений. В то же самое время, быстрая пролиферация и фрагментация могли бы оказать здоровую и рефлексивную силу на зрелость международного права.
