Rezumat

The legal regime of the criminal complaint is stipulated in art. 276 - Initiation of criminal prosecution based on the victim‘s complaint from the Code of Criminal Procedure of the Republic of Moldova. According to the provisions of the norm in question, the criminal complaint is addressed to the criminal investigation body and is examined by the given body, the very beginning of the criminal investigation and the conduct of the investigations being made in general. If, following the offenses mentioned in par. (1) in art. 276 of the CPC of the Republic of Moldova suffered several persons, the initiation of criminal proceedings is made even if the preliminary complaint is submitted only by one of the victims (paragraph (2) of art. 276 of the CPC of the Republic of Moldova). In the cases provided for above, the complaint shall be lodged in person by the victim or by his or her authorized representative. If the complaint is filed by another person (spouse or close relative), the victim may declare that he does not accept such a complaint and consequently the process cannot be initiated, ordering the solution of not starting the criminal investigation. In the case of notifying the investigating bodies by any other way than by the prior complaint of the victim, the criminal investigation officer or the prosecutor has the obligation to explain to the victim the right to submit such a complaint, according to art. 277 of the CPC of the Republic of Moldova. At the same time, when submitting the preliminary complaint in the cases provided by par. (1) in art. 276 of the CPC of the Republic of Moldova, the criminal investigation officer explains to the victim the right to withdraw the complaint and the right to reconcile with the perpetrator.
