Rezumat

A ssistance with medicines is carried out by a complex system in which coexist much more interdependent components, beginning with the idea of creation and marketing. One of these components is the solicited sign for class 05 (assignment of a name under which it would be marketed). With respect to similarity it shall be treated from the viewpoint of specific features of the pharmaceutical preparations: 1. The pharmaceutical preparations are marketed in specialized chemist’s shops (self-service being excluded) 2. Most of pharmaceutical preparations are solicited in chemist’s shops under medical prescriptions, indicating the correct name of the preparation (including form of release, dose and mode of administration). The optimal number of letters which differ, in order to exclude the risk of confusion, shall be, in my opinion, of three. It should not be taken into account (as a different letter) cases relating to the specific features of Latin orthography (th-, ch-, ph-) or of interchangeable letters (m-n, b-p, z-s). With respect to limitation we have studied two cases: 1. Names indicating the specific action of preparations on certain organs or systems. In the consumer’s consciousness (notwithstanding the origin) any pharmaceutical preparation containing in its name such elements as nephro-, cardio-, arthro-, neuro-, mio-, would occur associations with specific actions upon one organ or system. Limitation of such kind (only for preparations with action upon the cardiovascular, nervous system, etc.) is known and used by many offices, and also within the framework of our division. 2. Names having endings specific to their groups, which as a result of long utilization were associated in the consumer’s consciousness as being characteristic of certain pharmacological groups. For example: “-algin, -idol” - for analgetics, antipyretics; “-cain” - for anesthetics; “- mycin, -cillin, -cyclin” - for antibacterial preparations; “-vit” - for vitaminal preparations; “- vir” - for antiviral preparations, vaccines, sera; “ceph-“ - for cephalosporine. The name which will have such ending, will always be associated in the consumer’s consciousness with the group of anesthetic, antibacterial preparations, etc. The study on this matter shows that offices have reasons to be reserved on this kind of limitation. Diagrams, in their turn, indicate the total number of signs having as their components the aforementioned specific endings, the number of limitations effected by different offices on these reasons and the number of self-limitations effected by the applicants. Following the diagrams, one can observe that the applicant himself (by means of self-limitations) accepts the idea of goup affiliation according to the assigned endings. From the Aforementioned discussion one can conclude that limitations of such kind could be welcomed, studying beforehand which endings are well-known to the consumer and what are the groups he associates them with.
