From the perspective of criminal law, it is admissible that freedom, enshrined in the Constitution of the Republic of Moldova and in international acts to which the Republic of Moldova is a party, be addressed, among other things, in terms of mental freedom. Not only this demonstrates that art. 155 of the Criminal Code of the Republic of Moldova corresponds to the principle of a legitimately protected social value. Like the incrimination of any other act, the incrimination of the act provided in art. 155 of the Criminal Code of the Republic of Moldova presupposes the restriction of certain rights and freedoms. This restriction corresponds to the conditions provided in par. (2) art. 54 of the Constitution of the Republic of Moldova. Art. 155 of the Criminal Code of the Republic of Moldova is the only measure that can achieve the purpose of preventing and combating the threatening murder or severe bodily injury or damage to health. Other legal measures – civil, administrative, disciplinary, etc. – cannot be considered sufficient and effective in achieving this goal. In conclusion, art. 155 of the Criminal Code of the Republic of Moldova is in accordance with the principle of a legitimately protected social value and with the principle of ultima ratio. |
