The subjective side of the crime of little water pollution has been analyzed in the national criminal doctrine, sometimes even superficially. In the criminal legal literature there is no single point of view on the form of guilt of the subjective side of the crime of water pollution, opinions are divided. Therefore, in this article we try to perform a subjective analysis of the subjective side of the crime of water pollution (art.229 CP RM). In this sense, some important qualification rules are highlighted according to the subjective side. It is argued that the crime of water pollution can be committed both intentionally and recklessly. |
