Rezumat

Land registration is defined as a set of legal rules having as object knowledge by third parties of the operations of constitution, transmission or extinction of real estate rights and personal rights. Land registration is the legal document that organizes the enforceability against third parties. Land registration is a measure to protect those persons ( third parties ) that they were unaware of the existence of a right not transcribed, but have acquired (the legal documents for consideration) those rights that they have transcribed. So, to ensure enforceability against third parties in Moldova, it was established as a requirement for the land buyer to submit the contract of sale in the Land Register in whose activity area the land is situated for registration of ownership on it. This is stipulated in Paragraph 3 of Article 5 of Law on normative price and sale -purchase of land, number 1308 of 25/07/1997 At the same time, Article 214 of the Civil Code of the Republic of Moldova establishes the obligation of registration of juridical acts regarding immovable property, including land. The unregistered ownership on a sector of land is considered void in relations with third parties, including the state, which is presumed not knowing about the existence of this right
