Rezumat

International law rests on state sovereignty and the principle of sovereign equality is the first governing principle of the United Nations according to Article 2(1) of the UN Charter. The preamble of the North Atlantic Treaty (1949) refers explicitly to the “goals and principles of The United Nations Charter”, thus, it implicitly refers to the principle of sovereign equality. The preamble of the European Community Treaty (1957) refers to “the principles of the United Nations Charter” as far as the solidarity between Europe and overseas countries is concerned. These principles are also mentioned by article J.1 of the Treaty on European Union (Maastricht, 1992, now article 11 since the Amsterdam Treaty, 1997), which deals with the aims of the Common foreign and security policy (CFSP). All these references do not suffice to reassure “Eurosceptics” and opponents to the Uniting of Europe. They fear consequences of military integration in NATO and economic, legal and political integration in the European Union. Are these fears justified?
