Rezumat

This article analyzes some features of criminalization of the offense of coercion to testify under Article 309 of the Criminal Code of the Republic of Moldova. It argues the opportunity and the need to criminalize this act, based on the idea that justice in a state of law must be efficient, and this requires strict observance of the law by representatives of the judicial power and by the persons responsible for liability contributing to justice. The article motivates the conclusion that the issue of liability for coercion to testify should be resolved based on the need to ensure balance between the interests of society of combatting crime and of respecting legitimate rights of man and citizen. The study brings some arguments about the need to improve the existing criminal legal framework.
