Rezumat

Potrivit prevederilor normei constituționale, „Voința poporului este baza puterii de stat. Această voință este exprimată prin alegeri libere, care se desfășoară periodic prin exprimare universală, egală, directă, secretă și liberă”. În contextul alegerilor parlamentare din 24 februarie 2019, autorii investighează evoluția încercării de uzurpare a puterii de stat în perioada 7-15 iunie 2019, în care Curtea Constituțională a fost direct implicată. Analizând comportamentul și hotărârile Curții Constituționale, autorii formulează o serie de concluzii, elaborând un set de recomandări pentru justiția constituțională din Republica Moldova. Misiunea Curții Constituționale este să garanteze supremația Constituției, să asigure realizarea principiului separării puterii de stat și să garanteze responsabilitatea statului față de cetățean și cetățean față de stat. Suveranul și voința lui sunt baza puterii de stat, unde Curtea Constituțională este autoritatea jurisdicției constituționale, care stă la paza Constituției și a voinței poporului moldovenesc

According to the provisions of the constitutional norm, “the will of the people is the basis of the state power. This will is expressed through free elections, which take place periodically through universal, equal, direct, secret and free expression.” n the context of the parliamentary elections of February 24, 2019, the authors investigate the development of the attempted usurpation of the state power from June 7-15, 2019, in which the Constitutional Court was directly involved. By analyzing the behavior and judgments of the Constitutional Court, the authors draw a series of conclusions, elaborating a set of recommendations for constitutional justice from Republic of Moldova. The Constitutional Court’s missia is to guarantee the supremacy of the Constitution, to ensure the realization of the principle of the separation of state power and to guarantee the state’s responsibility towards the citizen and the citizen towards the state. The sovereign and his will are the base of the state power, where the Constitutional Court is authority of constitutional jurisdiction, which is the guard of the Constitution and the will of the Moldovan people.
