В статье изложен анализ практики Европейского суда по правам человека, на основании которого определен механизм применения норм Конвенции о защите прав человека и основных свобод. Решения Суда сгруппированы по предмету их рассмотрения – права, нарушение которого установлено. В результате подробного анализа решений установлены общие правила, которых придерживается Европейский суд при рассмотрении дел, а также определены факты, которые признаются нарушением норм Конвенции. Освещены вопросы субсидиарного применения Судом норм Конвенции и их расширенного толкования.

The article contains an analysis of the practice of the European Court of Human Rights, on the basis of which the mechanism for applying the norms of the Convention for the Protection of Human Rights and Fundamental Freedoms was defined. Decisions of the Court are grouped on the basis of the subject matter of their consideration – the right, the violation of which is established. On the basis of a detailed analysis of certain decisions, the general rules that the European Court adheres to in the examination of cases are established, as well as facts that are recognized as violations of the norms of the Convention. The issues of the Court’s subsidiary application of the norms of the Convention and their expanded interpretation are highlighted.

Articolul conține o analiză a practicii Curții Europene a Drepturilor Omului, pe baza căreia a fost definit mecanismul de aplicare a normelor Convenției pentru apărarea drepturilor omului și a libertăților fundamentale. Deciziile Curții sunt grupate în funcție de obiectul examinării - dreptul, a cărui încălcare este stabilită. Ca urmare a unei analize detaliate a anumitor decizii, se stabilesc regulile generale pe care Curtea Europeană le urmează în examinarea cauzelor, precum și faptele care sunt recunoscute drept încălcări ale normelor Convenției. Se subliniază aspectele legate de aplicarea subsidiară a Curții de către normele Convenției și de interpretarea extinsă a acestora
