Стаття присвячена правовим проблемам донорства і трансплантації. Пропонується виокремити такі види донорства: 1) крові, її компонентів; 2) органів людини, їх частин чи інших анатомічних матеріалів; 3) репродуктивних тканин. У межах статті проаналізовано перші два види. Визначено основні складові права на донорство крові та її компонентів в Україні, виокремлено наступні критерії для реалізації права на донорство: медичний, юридичний, соціальний. Досліджено моделі правового регулювання донорства після смерті. Аргументовано, що Україні необхідно відійти від моделі згоди на користь моделі припущення загальної згоди

The article is devoted to legal problems of donation and transplantation. The following types of donation are singled out: 1) blood, its components; 2) human organs, their parts or other anatomical materials; 3) reproductive tissues. Within this article, we will analyze the first two defined types. We will determine the main aspects of the right to blood donation and its components in Ukraine. The following criteria for realization of the right to the donation are distinguished: medical, legal, social. Models of legal regulation of donation after death are investigated. It is proved that Ukraine needs to move away from the model of consent in favor of a model of the assumption of general consent..  

Articolul este dedicat problemelor legale ale donării și transplantului. pentru a distinge astfel de tipuri de donație: 1) sânge, componentele sale; 2) organe umane, părți sau alte materiale anatomice; 3) țesuturile reproductive. În cadrul acestui articol, vom analiza primele două specii specifice. Definiți principalele componente ale dreptului de a dona sânge și componentele sale în Ucraina. să aloce următoarele criterii pentru realizarea dreptului de a dona: medical, legal, social. Modelele de reglementare juridică a donării după moarte sunt investigate. Se susține că Ucraina trebuie să se abată de la modelul de consimțământ în favoarea modelului, presupunând un acord general.
