The rules of law governing the jurisdiction are described in the Code of Civil Procedure, but contain similar provisions and other regulations, such as for example the insolvency law. In fact, the first instance court in civil proceedings is the Court and insolvency cases are examined by the Court of Appeal as a first instance court. When in a civil action the position of defendant is held by a company that is in the process of insolvency, and the object of the action is not part of the debtor mass , the action in question will be examined by the Court, as a first instance court. Unfortunately, magistrates often do not perceive these procedural issues and allow a series of judicial errors from which results a different practice in identical civil cases. The only legal leverage to eliminate errors and repair injustices admitted to first instance courts , remains the execution of legal remedies established by law and guaranteed by Article 119 of the Constitution of Moldova. |
