В статье проводится теоретическое исследование сравнительного анализа субъектов нотариального процесса в Украине и Молдове. Раскрываются понятие субъектов нотариального процесса и нотариуса. В статье рассмотрены законодательные акты, регулирующие нотариальную деятельность, в частности доступ к профессии нотариуса. Автором произведен сравнительный анализ органов и должностных лиц, на которых законодательством обеих республик возложено право совершать нотариальные действия. Выявлены общие черты и отличия в правовом регулировании нотариального процесса в Украине и Республике Молдове. Исследуются пути усовершенствования законодательства, регулирующего право на осуществление нотариальной деятельности.

The article deals with the theoretical research of the comparative analysis of the subjects of the notarial procedure in Ukraine and Moldova. The concept of subjects of notarial procedure and notary public are revealed. Legislative acts regulating the notarial activities, in particular access to the profession of the notary public are examined. The author has made a comparative analysis of the bodies and officials who can the right to perform notarial acts according to the legislation of both republics. Similarities and differences in legal regulation of the notarial procedure in Ukraine and Moldova are considered. The ways of improving the legislation regulating the right to carry out notarial activities are investigated

Cercetarea este dedicată problemelor actuale ale reglementării legale a activității notariale în Ucraina și Republica Moldova. Se dezvăluie noțiunea de subiecte de proces notarial și notariat. Articolul se referă la actele legislative care reglementează activitatea notarială, în special accesul la profesia notarială. Autorul a efectuat o analiză comparativă a organelor și a funcționarilor, cărora le este încredințată legislația ambelor republici cu dreptul de a efectua acte notariale. Se dezvăluie trăsăturile și diferențele de ordin juridic ale activităților notariale din Ucraina și Republica Moldova. Sunt investigate modalitățile de îmbunătățire a legislației care reglementează dreptul de a desfășura activități notariale.
