In this article the authors examine some of the problematic issues of classification of criminal offenses such as riotous disturbances. The methods of committing organizational actions during the riotous disturbances, as well as active participation in the commission of disorderly crowd violence against people by participants; pogroms, arson and destruction of property; the eviction of citizens, armed resistance to the authorities; aggravating circumstances of riotous disturbances are considered. The differences in classification of penal actions are brought, which include responsibility for the organization or active participation in the commission of mass riots and other offenses: hooliganism committed by a group of persons; group violations of public order; incitement to commit acts that threaten public order; seizure of state or public buildings, etc.

У статті досліджуються проблемні питання кваліфікації масових заворушень. Розглядаються способи здійснення організаційних дій під час масових заворушень та активної участі в учиненні учасниками натовпу, що безчинствує, насильства над особою; погромів, підпалів і знищення майна; насильницького виселення громадян, озброєного опору представникам влади; кваліфіковані ознаки масових заворушень. Наводяться відмінності у кваліфікації кримінально-караних дій, які передбачають відповідальність за вчинення масових заворушень і хуліганства, вчиненого групою осіб; групового порушення громадського порядку, закликів до вчинення дій, що загрожують громадському порядку, захоплення державних або громадських будівель чи споруд тощо.
