Rezumat

In the realm of this scientific article we have analyzed the concept of the religious freedom as a social value protected by the Criminal law and its limits of application under the interpretations offered by the ECHR jurisprudence. The purpose of this study consisted in defining the concept of the religious freedom, clarification of its limits, as well as demonstration of the fact that the abusive proselytism constitutes exceeding of the limits imposed by the religious freedom of another person by means of illegal intrusion in his private life. A sensible aspect which is linked to establishing of the religious freedom’ borders and their exceeding by means of the proselyte behavior of others, have been analyzed. In order to formulate clear and exhaustive answers we have consulted the most famous ECHR case law and have learned scientific results of the highly regarded authors in the domain. As a result, we have formulate some conclusions which, in our opinion, will contribute substantially to the interpretation of the concept of religious freedom in the modern penal doctrine, as well as of the phenomenon of the abusive proselytism in the criminologist science.
