Starting from the provisions of the Constitution and the legal framework of the Republic of Moldova, researching the legal regimes of the constitutional authorities of other countries, but also analyzing the scientific investigations in the field, the author presents considerations regarding the legal regime of the authority of constitutional jurisdiction, but also on the activity of the Constitutional Court which performs improper functions in an incomplete composition. Researching the cases of noncompliant activity, the author comes up with rigorous proposals to ensure the activity of the Constitutional Court strictly within the legal framework, to guarantee the fundamental rights and freedoms of man, society and the state, but also the real supremacy of the Constitution of the Republic of Moldova. |
