The detection of traffic violations is a process to which the detecting agent must adhere with the greatest seriousness shown by observing the rigors of the contravention law, which conditions the respective procedure. The fact that the misdemeanor according to the notion provided by the Contraventional Code is identified as an illegal with a lower degree of social danger than the crime, should not have a negative influence on the documentation of the misdemeanor, including the contraventions in the field of road traffic. The jurisprudence of the European Court of Human Rights expressly stipulates the fact of associating the documentation of a contravention with the fact of committing a crime, a condition that obliges the investigating agent that all documented contraventions, including those initiated on the basis of personal findings, be accompanied by evidentiary material accumulated in accordance with the requirements of the contravention and procedural law criminal.

Constatarea contravențiilor rutiere este un proces față de care agentul constatator trebuie să se atârne cu cea mai mare seriozitate manifestată prin respectarea rigorilor legii contravenționale, care condiționează prpocedura respective. Faptul că contravenția conform noțiunii oferite de Codul Contravențional este identificată drept un ilicit cu un grad de pericol social mai redus decît infracţiunea, nu trebuie să influențeze negative asupra documentării contravenției, inclusive și al contravențiilor din domeniul circulației rutiere. Jurisprudența Curții Europene a Drepturilor Omului expres statutează faptul asocierii documentarii unei contravenții cu faptul comiterii unei infracțiuni, condiție care obligă agentul constatator ca toate contravențiile documentate inclusiv și cele inițiate în baza constatărilor personale să fie însoțite de un material probatoriu acumulat conform cerințelor legii contravenționale și procesual penale.
