Individual freedom and security of the person is one of the most sensitive and complex human values which, along with other fundamental rights, plays a primordial role in a democratic society. In the following, we present some aspects of criminal law of the illegal performance of abortion misdemeanor as it is criminalized in the criminal law in force of the Republic of Moldova (RM) under art.159 of the Criminal Code (CC). The illegal performance of abortion is undoubtedly one of the few crimes against the life and health of a person that has experienced a different approach during the whole human existence: from the most severe punishment to decriminalization. |

Provocarea ilegală a avortului este, incontestabil, una dintre puținele infracțiuni contra vieții și sănătății persoanei care a cunoscut de-a lungul existenței umane o abordare inedit de diferită: de la instituirea celor mai severe pedepse până la dezincriminarea acesteia.</p></description> <description xml:lang='ru' descriptionType='Abstract'><p>Ниже мы представим некоторые нормативно-правовые аспекты преступления незаконной провокации аборта, инкриминируемого действующим уголовным законодательством Республики Молдова в статье 159 Уголовного кодекса. Нелегальная провокация аборта, бесспорно, один из немногих преступлений против жизни и здоровья человека, который во время своего известного человеческого существования необычно иной подход: от введения самых суровых наказаний к его декриминализации.</p></description> </descriptions> <formats> <format>application/pdf</format> </formats> </resource>
