The rights protected by Article 3 of the Rome Convention (1950) are directly connected with the integrity of a person and human dignity of a person. Therefore, an interdiction of torture, inhuman or degrading punishment or treatment represents, hence, certain rights of an extremely serious nature. In the case of Ireland v. United Kingdom European Court of Human Rights made a difference between the three essential notions of art.3 according to the level of severity of treatments or punishments: torture: inhuman treatment applied intentionally and inducing very grave and very cruel suffering; inhuman treatment or punishment: application of an intense suffering, physical or mental; degrading treatment: a treatment that creates a victim’s sentiment of fear, anxiety and abjection, which humiliate, disparage and eventually break this person’s physical and moral resistance. |
