Rezumat

Analysis of the current legislation of the Republic of Moldova on health care in the field of transplantation of organs and tissues suggests that the legal basis of this issue has a number of gaps. Thus, the issues of informed voluntary consent for medical intervention have not been resolved, there is no unequivocal definition of a circle of donors, and problems of civil law regulation of a contract for the provision of transplant medical services have not been resolved. In this connection, it is inevitable that it is necessary to determine the nature of the relationship that develops during transplantation of human organs and tissues, as well as the structure of relationships that take shape in the course of organizing and directly providing transplant medical care.
