Tourism is a booming industry and the need to establish some agreements between tour operators in in order to sell a tourism product, but also for tourists, in order to obtain quality services, generates tourism contracts. A tourist services contract provides the marketing of tourism package, rights and obligations of contracting parties, and penalties for failure to timely and adequate benefits agreed between the parties. The tourism statistics represented by activity of travel agencies both in Romania and Moldova show that the tourists prefer an organized tourism, use the services offered by travel agencies. Tourists buy packages and ensure the provision and quality of services, by concluding contracts the tourism services, which is the legal relationship between the travel agency and tourist, without which their work would not be possible, and the degree of satisfaction, of recreation and leisure needs of tourists would be reduced.
