Rezumat | ||||||
In accordance with its internal regulations, the purpose of the European Commission for Democracy through Law is to issue opinions, both on its own initiative and (most often) at the request of the authorized institutions (to request such opinions) of the state. The recommendations of the Venice Commission may be issued in the form of studies, amicus curiae reports, reports and practical guidance for its previously issued opinions. Commission’s recommendations are „soft law”, is non-binding legal instruments, so in contemporary international law there is a tendency to supplement or replace the traditional „hard law” (that is to say, the traditional mandatory law) with soft law (that is, apparently non-legal norms). Therefore, the article aims at a scientific analysis of how the Republic of Moldova understands the legal nature of the Venice Commission recommendations. |
