Rezumat

Self‑determination is a very important principle in the constitutional Law and public international Law foreseen the possibility and capacity of people to own their territory. The international practice accounts many cases where have been used the norms of international law in order to settle different interethnic conflicts. The contemporary international Law starts from a conception of direct and harmonious relation between rights and freedoms of a person and a society, community he is being a part of. This relation has a definite influence on the content, mode and conditions of exercising of the individual rights and freedoms, as well as on the collective rights. There is a general opinion that self‑determination has direct ties with independence and that in Charter of United Nations the self‑determination has been treated in the same terms. It’s not a right opinion as self‑determination hasn’t been mentioned in the Universal Declaration of People’s Rights from 1948, though in preamble there is a reference to the development on the bases of friendship in relations between nations.
