A complex juridical-penal analysis of the offences provided by art.264 of the Criminal Code of Republic of Moldova is carried out in the framework of the present paper. Utilizing a large number of examples from the national judicial practice, the examination of the integrant elements of the mentioned offence is undertaken – the offence object, the objective side of the offence, the subjective side of the offence, the offence subject. The specific aggravated circumstance of the offence provided by art.264 of the Criminal Code of Republic of Moldova, committing the crime being intoxicated, is analyzed as well. The conclusions and the recommendations formulated in the framework of this study can be used in the practical activity, in the process of improving the penal law, as well as in the didactic process. |
