In the present article it is analyzed the phenomenological aspect of the special confiscation, with reference to the legal norms in force and the doctrinal interpretation of the law, starting from the legal sources of law, the evolution of the law,identification of the gaps and the solutions regarding the improvement of the legal framework regulating the subject. The theoretical and application value of this article has it’s purpose in the creation of an unofficial source of interpretation of the law, formulationg proposals for amending the criminal law and harmonizing of the practice in the applying of the safety measure – special confiscation. |
