Rezumat

In this article the ideas of Constantin Stere regarding the phenomenon of law are analyzed. The scholar considers that law appears in a human society at the same time with the state as a result of appearance of private property and the differentiation of society in social classes. However, his vision differs from the materialistic approach by marking of the role of human individuality as an active factor of social progress. The constitutionalist sees law as a result of balance of different social forces. In this article it is stipulated that the visions of Constantin Stere in regard to law were heavily influenced by the concept of the great Austrian scholar Rudolph von Ihering in the respective problem. Also, some tangents between Constantin Stere and the scholar Mircea Djuvara in their concept regarding law are put in evidence.
