În acest articol s-a făcut o cercetare a evoluției contractului  colectiv de muncă şi convenţiei colective. S-a analizat: natura juridică şi efectele contractului colectiv de muncă; doctrina occidentală de la sfîrşitul secolului al XIX-lea şi începutul secolului al XX-lea și au fost au fost evidențiate mai multe teorii vis-a-vis de materia dată. Cum ar fi: teoriile contractualiste; teoria mandatului; teoriile reglementare sau extracontractuale. S-a făcut referire la  mai multe definiţii ale contractului colectiv de muncă expuse în literatura juridică de specialitate, la definiţia legală a noţiunii de contract colectiv de muncă prevăzută în legislaţia Republicii Moldova. S-a argumentat faptul că, în sistemul general al izvoarelor de drept, contractul colectiv de muncă face parte din categoria contractelor normative, adică din categoria actelor juridice care îmbină trăsăturile contractului civil cu cele ale actului normativ.

In this article there has been made a research of the evolution of the collective employment contract and of the collective convention. There has been analyzed: the legal nature and the effects of the collective employment contract; the Occidental doctrine from the end of the XIX-th century and the beginning of the XX-th century and there have been highlighted more theories related to this subject. Some of them would be: the contractual theories; the mandate theory; the regulated or extracontractual theories. We have made reference to more definitions of the collective employment contract exposed in specialized legal literature and also to the legal definition of the notion of collective employment contract as stipulated in the legislation of the Republic of Moldova. There has been brought arguments of the fact that within the general system of the sources of law the collective employment contract belongs to the category of the legal acts that combine features of the civil contract with those of the normative act.
