Rezumat

The article is dedicated to the analysis of the scientific visions of Constantin Stere about the origins of state, expressed in his scientific works. The scholar has the opinion that the state is a product of the historical evolution. State appears as a political organization of the society as a result of the processes of emancipation of individuals and the appearance of private property. The distinctive trait of the sterean concept of the origin of state is manifested in the decisive emphasis of the importance of the individual human emancipation. Stere expresses his scientific disagreement vis-a-vis the postulates of the theory of the social contract as one of the doctrines related to the origins of a state, considering it false from the point of view of the historical evolution of humanity. However, the constitutionalist considers that this theory, in fact, formulates, an ideal which the human society aspires to achieve. The constitutionalist points out, in fact, the importance of the respective theory, which proclaimed the natural human rights and, from the point of view of positive law, lays at the base of the modern constitutionalism.
