Стаття присвячена висвітленню проблеми встановлення нотаріусом особи, яка звернулася за посвідченням договору відчуження нерухомого майна. Зроблено висновок, що діяльність нотаріуса зі встановлення особи, яка звернулася за посвідченням договору відчуження нерухомого майна, полягає у встановленні за дозволеними законодавством документами прізвища, ім’я, та по батькові особи, її віку, статі, адреси реєстрації місця проживання та інших реквізитів, які можуть характеризувати особу. Проаналізовано особливості окремих документів, на підставі яких нотаріус може встановлювати особу. Досліджено процедуру встановлення нотаріусом особи, яка на час вчинення нотаріальної дії є малолітньою (неповнолітньою). Зроблено висновок про недосконалість законодавства про нотаріат. За наслідками дослідження сформульовано пропозиції з вдосконалення чинного законодавства.

The article is focused on the issue of identification by a notary of an individual who has applied for certification of the agreement on alienation of immovable property. It has been concluded that notary activity on identifying an individual who has applied for certification of the agreement on alienation of immovable property consist of establishing an individual`s last name, first name and patronymic, his/her age, sex, address of registered residence and other details that could characterize an individual based on documents prescribed by legislation. The peculiarities of particular documents based on which a notary could identify a person have been analyzed. The procedure of identification by a notary of a person who is a minor (underage) at the moment of notary act performance has been examined. The conclusion about deficiencies in the notary legislation has been made. According to the results of the research, suggestions were made to improve current legislation.
