Rezumat

Actualitatea prezentei cercetări este determinată de articularea nevoilor societății într-un sistem economic eficient, capabil să contribuie la îmbunătăţirea calităţii vieţii. Pornind de la dezideratul că instituirea și garantarea unui astfel de sistem economic este posibil doar prin mijloace juridice, este prezentată o analiză de drept comparat a principiilor care formează fundamentul constitutional al relațiilor din acest domeniu. Pentru studierea respectivei teme au fost examinate o serie de principii care stau la baza sitemului economic contemporan. În rezultatul examinării mai multor constituții din cadrul familiilor romano-germanică, anglo-saxonă, dreptului musulman, s-a constatat că, textele constituţiilor în vigoare cuprind multe dintre ideile şi concepţiile elaborate de istoria umanităţii cu privire la regulile de care trebuie să se călăuzească statul în procesul de reglementare a relațiilor economice, inclusiv instituirea unor măsuri chemate să protejeze libertatea individuală în relațiile economice, protecția tuturor intereselor economice legitime, protecția competiției economice libere, sancționarea persoanelor vinovate în acțiuni ce atentează la libertatea economică, proprietate sau prevederi contractuale, contracararea fenomenelor economice negative etc.

The actuality of the present research is determined by the articulation of the needs of the society in an efficient economic system, capable of contributing to the improvement of the quality of life. Starting from the fact that the establishment and guarantee of such an economic system is possible only through legal means, a comparative law analysis of the principles that form the constitutional basis of the relations in this field is presented. In order to study the respective theme, a series of principles that underlie the contemporary economic system were examined. As a result of examining several constitutions within the Romano-Germanic, Anglo-Saxon, Muslim law, it was found that the texts of the constitutions in force encompass many of the ideas and conceptions elaborated by the history of humanity regarding the rules that should guide the state in the process of regulating economic relations, including the establishment of measures called to protect individual freedom in economic relations, protection of all legitimate economic interests, protection of free economic competition, sanctioning of guilty persons in actions that violate economic freedom, property or contractual provisions, counteracting negative economic phenomena etc.
