У статті розглянуто та охарактеризовано поняття правозахисних гарантій прав людини в Україні, судового захисту, а також визначено їх місце в структурі механізму правового захисту. Визначено судовий захист у системі правозахисних гарантій прав людини в Україні. Встановлено, що судова влада є основою, фундаментом правової держави та громадянського суспільства, без професійної діяльності якої насамперед на засадах абсолютної незалежності взагалі ставиться під сумнів її існування. Рівень розвитку судової системи безпосередньо вказує на рівень демократії в суспільстві.
