In the doctrine of the constitutional and international human rights law, it is unanimously accepted that the right to respect for private life is not absolute. The universal instruments, including the regional ones developed in the post-war period, as well as the domestic laws, establish limits to the state’s interference in the exercise of the right to respect for private life, family life, home and correspondence. Under the circumstances of contemporary life marked by globalization, technical and scientific progress and technological achievements, the threats to peace, international security and public order of states all over the world have increased. In the absence of detailed international regulations in the field of investigation, prosecution and prevention of international crimes, it is now up to the States to promptly create a consistent regulatory framework, appropriate for the reconciliation of international and national security imperatives, with the obligations to protect human rights and fundamental freedoms. |
