Rezumat

Potrivit art. 97 alin. 3 C.pr.pen. legiuitorul a prezentat trei concepte privind probele şi anume: proba, mijloacele de probă şi procedeele probatorii. Proba reprezintă elementul de fapt care serveşte la constatarea existenţei sau inexistenţei unei infracţiuni, în timp ce mijlocul de probă îl reprezintă modalităţile legale folosite pentru dovedirea elementelor de fapt. Deşi în limbaj juridic în noţiunea de probă este inclusă atât proba propriu-zisă cât şi mijlocul de probă, sub aspect tehnic procesual ne aflăm în faţa a două noţiuni distincte. Pornind de la aceste considerente, lucrarea de faţă analizează percheziţia informatică ca procedeu probatoriu, tocmai pentru a înlătura confuzia cu raportul de constatare tehnico-ştiinţifică care se dispune de către procuror doar atunci când există pericolul dispariţiei unor mijloace de probă sau de schimbare a unor situaţii de fapt. Referitor la competenţa organelor judiciare care pot dispune efectuarea percheziţiei informatice, pe parcursul urmăririi penale aceasta poate fi dispusă de către judecătorul de drepturi şi libertăţi, la cererea procurorului care trebuie să fie motivată, în timp ce pe parcursul cercetării judecătoreşti este dispusă de către instanţa de judecată, din oficiu sau la cerere. Percheziţia informatică se desfăşoară în două faze, prima dintre acestea constând în copierea datelor informatice din sistemul informatic sau din suportul de stocare al datelor informatice, pentru ca în faza a doua să aibă loc percheziţionarea efectivă a copiei, asigurându-se în acest fel integritatea datelor supuse percheziţiei

According to art. 97 paragraph 3 Code of Cr.Pr. the legislator presented three concepts of evidence, namely: evidence, evidence and evidentiary procedures. The evidence is the fact that serves to establish the existence or non-existence of a crime, while the means of proof is the legal means used to prove the facts. Although in the legal language in the notion of proof is included both the proof itself and the means of proof, we are in the technical aspect of procedural two distinct notions. Based on these considerations, the present paper analyzes the computer search as a probative process precisely to eliminate confusion with the technical-scientific finding report available to the prosecutor only when there is a danger of the disappearance of evidence or change of circumstances actually. Regarding the competence of the judicial bodies that may order the execution of the computer search, during the criminal prosecution it may be ordered by the judge of rights and freedoms at the request of the prosecutor who must be motivated, while during the judicial inquiry is ordered by the court judging, ex officio or on request. The computer search takes place in two phases, the first of which consists of copying the computer data from the computer system or from the storage medium of the computer data so that in the second phase the actual search of the copy takes place, thus ensuring the integrity of the data subject to search.
