Статья посвящена анализу терминологического значения понятия «потерпевший» в законодательстве Украины и юридической науке. Раскрывается соотношение понятия «потерпевший» с понятиями «жертва» и «пострадавший» с точки зрения юридических фактов, связанных с нарушением прав человека, которому причиняется вред или ущерб. Выясняются критерии определения статуса потерпевшего с точки зрения конституционно-правового отношения права человека и соответствующей обязанности государства по его защите, обосновывается широкий подход к определению понятия потерпевшего в юридической науке.

The article is devoted to the analysis of the terminological meaning of the concept “victim” in the legislation of Ukraine and legal science. The relationship between the notion of a victim and the notions of “sacrifice” and “injured” is revealed from the point of view of legal facts related to the violation of human rights, which is harmed or damaged. The criteria for determining the status of the victim from the point of view of the constitutional-legal relationship of human rights and the corresponding obligation of the state to protect him are clarified, a broad approach to the definition of the concept of victim in legal science is substantiated.
