The international law of the sea establishes the public order of the seas and oceans. A comprehensive tool in this area is The United Nations Convention on the Law of the Sea (UNCLOS) of 1982, adopted in Montego-Bay, Jamaica, which is considered to be in effect the International Maritime Code. Despite the fact that the Convention on the Law of the Sea contains a set of norms covering various institutions of the law of the sea, after the end of the Cold War, there is a resumption of disorder in the oceans. Violation of the rule of law in the sea space is manifested in acts of piracy, drug trafficking, illegal fishing, degradation of the sea environment, etc. Along with other illegal actions, it is a general danger for individuals to transport weapons of mass destruction by sea. Modern challenges and the vulnerability of the rule of law in sea spaces require a clear understanding from the point of view of the foundations of international jurisdiction on the high seas.

Dreptul internațional maritim stabilește ordinea publică a mărilor și oceanelor. Instrumentul cuprinzător în acest domeniu este Convenția ONU asupra Dreptului Mării din 1982 de la Montego-Bay, Iamaica, considerată un adevărat Cod internațional maritim. Deși Convenția asupra Dreptului Mării a stabilit un set de reguli ce cuprind variate instituții ale Dreptului Mării, după sfârșitul Războiului Rece se constată renașterea dezordinii în oceane. Declinul în spațiul maritim include pirateria, traficul de droguri și persoane, pescuitul ilicit, degradarea mediului maritim ș. a. Pe lângă alte practici ilegale, o nouă provocare o constituie traficarea armelor de distrugere în masă pe cale maritimă. Această nouă vulnerabilitate a spațiului maritim necesită expunere din punctul de vedere al temeiurilor jurisdicției universale în Marea Liberă

Международное морское право устанавливает публичный правопорядок морей и океанов. Всеобъемлющий инструмент в этой области является Конвенция ООН по морскому праву 1982 года принятая в Монтего-Бей, Ямайка, которая считается в действительности Международным Морским Кодексом. Несмотря на то что Конвенция по морскому праву содержит комплекс норм охватывающие разные институты морского права, после окончания холодной войны констатируется возобновление беспорядка в океанах. Нарушение правопорядка в морском пространстве проявляется в актах пиратства, торговли наркотиками, нелегальном рыболовстве, деградации морской среды и др. Наряду с другими противоправными действиями представляет всеобщую опасность транспортировка частными лицами оружия массового поражения морским путем. Современные вызовы и уязвимость правопорядка морских пространств требует четкого уяснения с точки зрения оснований международной юрисдикции в открытом море.
