Rezumat

В статье на основе теоретико-правового анализа информационно-познавательной деятельности следователя конкретизированы этапы процесса расследования. Предварительно с этой целью были выделены элементы уголовно-процессуальной формы, которые существенно влияют на организацию познавательного процесса в стадии досудебного расследования. Момент сообщения лицу о подозрении определяется как решающий для процесса расследования. Автор доказывает, что традиционная конструкция этого процесса не подлежит изменениям, а также конкретизирует момент разграничения начального и последующего этапа, основные задачи следователя на каждом из этапов. Констатирует, что расследование начинается с традиционного в криминалистике начального этапа, который длится с момента внесения информации о преступлении в Единый реестр досудебных производств до момента законного и обоснованного подозрения в совершении уголовного правонарушения конкретного лица.

The article based on the theoretical and legal analysis of the information-cognitive activity of the investigator, specifies the stages of the investigation process. For this purpose, elements of the criminal procedure have been singled out for this purpose, which significantly influence the organization of the cognitive process in the pre-trial investigation. The moment of reporting a person to suspicion is defined as decisive for the investigation process. The author proves that the traditional design of this process is not subject to change, and also specifies the time of the distinction between the initial and subsequent stages, the main tasks of the investigator at each of the stages. The author argues that the investigation begins with the traditional initial stage in forensic science, which lasts from the moment the information about the crime is entered into the Single Register of Pre-Trial Proceedings until the moment of legitimate and reasonable suspicion of a criminal offense of a particular person.
