В статье проводится теоретическое исследование проблем хозяйственно-правового обеспечения инвестиционной функции банков, которое обосновывается тем, что банковские учреждения являются важнейшим элементом всей экономики и организовывают движение и перераспределение ресурсов общества в целом. Через банковскую систему проходят денежные расчеты и платежи субъектов хозяйствования и населения в целом. Необходимость активизации участия банков в инвестиционном процессе обусловлена необходимостью успешного развития как банковской системы, так и экономики страны в целом. С одной стороны, банковские учреждения заинтересованы в стабильности экономики страны, это является необходимым условием их деятельности, а с другой – стабильность экономического развития в значительной степени зависит от уровня устойчивости, гибкости банковской системы и ее эффективного функционирования

In the article the theoretical research of providing the application of the problem of economic and legal provision of the investment function of banks, which states that banking institutions are an essential element of the reproductive structure of the economy and organize the movement and redistribution of resources of society in their monetary terms. Through the banking system are cash payments and payments of economic entities and the population as a whole. The need to increase the participation of banks in the investment process is conditioned by the need for successful development of both the banking system and the economy as a whole. On the one hand, banking institutions are interested in the stability of the economic environment, which is a necessary condition for their activities, and on the other hand, the stability of economic development depends on a large extent on the level of stability, flexibility of the banking system and its effective functioning.
