Статья посвящена анализу норм Инструкции о порядке выполнения норм международного гуманитарного права в Вооруженных Силах Украины, направленной на реализацию положений Закона Украины «Об обороне» и Военной доктрины Украины. Исследуется соотношение положений означенной Инструкции и Уголовного кодекса Украины в контексте реализации Украиной норм международного гуманитарного права, предлагаются подходы к усовершенствованию действующего уголовного законодательства Украины.

The article is devoted to the analysis of the norms of the Instruction on the procedure for the fulfillment of the norms of international humanitarian law in the Armed Forces of Ukraine, aimed at implementing the provisions of the Law of Ukraine "On Defense" and the Military Doctrine of Ukraine. The correlation of the provisions of the designated Instruction and the Criminal Code of Ukraine in the context of Ukraine’s implementation of the norms of international humanitarian law is explored, as well as the approaches to improve the existing criminal legislation of Ukraine are proposed
