Rezumat | ||||||
The primary purpose of this article is to elucidate and analyze the Process of conclusion of international treaties. Each treaty has some essential elements ( the Parties, the parties’ intention and the Object ) and secondary elements of the treaty ( Term and Condition ). The lack of secondary elements does not affect the validity of the treaty. If speaking about the shape of the Treaties: although the Convention acknowledges both the written form of international treaties, as well as oral form, the legislation of Moldova, through the Law no. 595, states only written form of international treaties. The actual phases of the conclusion of international treaties are: Development of the treaty text, Expression of the consent, Entrance into force of the treaty, the treaty Publication and Official Registration. |
