| Rezumat | ||||||
The national and international documents regarding the human protection are stipulating some rights regarding the human’s liberty, so that there is no institution which can limitate a person in his rights excepting the judgment instance. That means that after a judgment process only the judgment instance has the right to limitate a person in his rights, and the other authorities can only make suggestions, for example in our case of
submission in front of a medical examination of a person which has a mental disturbing. In this case the judgment instance, after examinating the demanding of a psychiatrist or of a tutelary authoritie to examine or to hospitalize the person which has a mental disturbing, can approve or reject de demanding. |
