Rezumat

The Constitution of the Republic of Moldova is the fundamental document that regulates by its provisions different control forms exercised on the central and local public administration. The Provisions of the Fundamental Law enforce the public administration to adopt or to issue in their activity legal administrative acts, which will not contravene to the Constitution and the laws of the Republic of Moldova.  The supreme law provides in the article 7 that any law or other legal act, which contravenes to the provisions of the Constitution, does not have legal power. Thus, the constitutional rule approves the legality as the fundamental principle of the rule of law. According to the constitutional rule, the legality supposes that the public authorities do not have to break the law and the adopted or issued administrative acts have to be based on the law, and their content has to to meet the law.  The fundamental law provides by the article 53 paragraph (1) the constitutional framework of exercising the fundamental rights of the injured individual by the administrative acts of the central and local public administration authorities. When referring to the local public administration acts, we consider the administrative acts adopted or issued by the local public administration authorities of first and second level and by public officers that work in the local public administration.  There are hereby analyzed the four control forms of local public administration acts legality, namely: compulsory control, optional control, the control requested by the local public administration authority and the control requested by the injured persons.
