The paper displays the way Romanian constitutional life was organized as well as the theory and constitutional practice marked by the two fundamental legal acts of Romania, which are the 1938 Constitution and the 1948 Constitution. The decade evoked in the paper represents a period of constituional discontinuity, of institutional regress marked not only by the changing of the government form but also by Romanian foreign policy. A period of a new legal order during which the transition from a parliamentary regime to one where the role of the executive was absolute, was made, a period of fundamental degradation of the constitutional institutions and of the public freedoms. The constitutional practice manifested after 1944 imposed different rules of a democratic regime: a constitution modified by a decree — law enacted by an assembly with no empowerment as a constitutional derived power and the action of a Council of Secretaries with legislative prerogatives by decree-laws. |
